Terms of Service

These Terms of Service ("Terms") govern your use of OnsitePeek (the "Service"), operated by [Your Company Name] ("OnsitePeek," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who can use OnsitePeek

You must be at least 18 years old to create an account, whether as a Requester (someone requesting a peek) or a Scout (someone providing one). By creating an account, you confirm you meet this requirement and that all information you provide is accurate.

OnsitePeek connects Requesters with nearby Scouts who provide a short live video look at a real-world location, in exchange for payment. OnsitePeek is a platform that facilitates this connection and processes payment. We are not a party to the interaction itself and do not guarantee the accuracy, quality, or availability of any peek.

5. Payments and fees

Payments are processed through Stripe, a third-party payment processor. By using the Service, you also agree to Stripe's terms of service. OnsitePeek retains a service fee from each transaction, with the remainder paid to the Scout. Current pricing is shown in the app at the time of each request.

Peeks are generally non-refundable once completed. If a peek fails to connect due to a technical issue on our end, you may be eligible for a refund at our discretion. [Add your specific refund policy here once decided.]

6. Independent contractor status

This section has real legal weight and genuinely needs a lawyer's review. Gig-worker classification law (who counts as an employee versus an independent contractor) varies significantly by state and is actively litigated.

Scouts are independent contractors, not employees, agents, or partners of OnsitePeek. Scouts set their own availability and are free to accept or decline any request. OnsitePeek does not control the manner in which a Scout completes a peek beyond the location verification requirement.

Video calls facilitated through the Service are not recorded or stored by OnsitePeek [update this if you later add recording]. By participating in a peek, both parties consent to a live video call for the purpose described in these Terms.

9. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. OnsitePeek does not guarantee the accuracy of any peek, the conduct of any Scout or Requester, or the availability of the Service at any given time. To the fullest extent permitted by law, OnsitePeek's total liability to you for any claim arising from your use of the Service is limited to the amount you paid to OnsitePeek in the 3 months preceding the claim.

We may suspend or terminate your account at our discretion for violating these Terms, including falsified location data, fraud, or harassment of other users.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
